Practical advice on debt recovery

Once a claim has been served, the debtor generally has 28 days to either pay the full amount claimed (including costs) or file a notice of intention to defend and a defence setting out the grounds of dispute. In some cases, the debtor may seek to negotiate a reduced settlement or enter into a payment arrangement.

Enforcing a judgment

  • Enforcement warrant – redirection of earnings, including garnishee of wages
